Landlord must give 60-Day Notice

Several new laws concerning landlords and tenants went into effect last year January 1, 2003.  Landlords should be aware of these new laws clearly designed to increase tenant rights and allow for penalties to landlords who don’t comply.  Now landlords must give the tenant 60-days notice if the tenant has lived in the property at least for a year.  There are some exceptions to this law, however, all of the following six conditions must apply.

  1. The owner has entered into a contract to sell the dwelling or unit to a bona-fide buyer for a specified value;

  2. The buyer is a natural person(s);

  3. The buyer in good faith intends to live in the property for at least one year after the termination of the tenancy.

  4. The termination notice is given within 120 days of opening escrow;

  5. The owner has established an escrow with a licensed escrow officer or a licensed real estate broker; and

  6. The dwelling or unit is alienable separate from the title to any other dwelling unit.

More legislation addresses the landlords right to enter the premises, details on how the landlord must notify tenant, limits on security deposits and stiff penalties for failure to comply and new standards for cleanliness. (Information obtained from C.A.R. Legal Services).
